No .86/2007 Change of Nord Pool Spot company structure in Sweden

As of 1 January 2008, all activities in Nord Pool Spot branch office in Sweden will be transferred to the newly established subsidiary Nord Pool Spot AB. Effective from the same date Nord Pool Spot’s branch office will be discontinued as a legal entity. All employees in the branch office will be transferred to Nord Pool Spot AB.

New counterparty and VAT procedure for physical trades in Sweden from 1 January 2008.

As a result of the corporate restructuring the counterparty for the trade of physical power in Sweden will change from Nord Pool Spot branch office to Nord Pool Spot AS. Therefore, please note in your accounts that Nord Pool Spot AS as of 1 January 2008 will be the counterparty for all ELSPOT and ELBAS trading in the exchange area.

As a consequence of the counterparty change the procedure for settlement of VAT will be altered pursuant to the European Union VAT legislation (EU directive no. 2003/92/EC).

Following the regulations concerning the place of supply of electricity and gas (VAT Act §63 d) the annual fixed fees for trading in ELSPOT and ELBAS, settlement of trades and trading fees will, be exclusive of VAT for the Swedish bidding area.

All Swedish participants must, in accordance with the European Union VAT legislation report VAT to the Swedish authorities themselves.
